Terms of Service

1. Eligibility

You must be at least 18 years old and able to form a binding contract. You are responsible for complying with the rules of any platform you use the Service with, including Upwork’s own Terms of Service.

2. The Service

KaamPakro Proposals helps freelancers decide whether an Upwork job is worth bidding on and generates a tailored proposal grounded in your own profile. The Service is an independent tool. It is not affiliated with, endorsed by, or sponsored by Upwork Global Inc. “Upwork” and “Connects” are trademarks of their respective owners and are used here only to describe interoperability.

3. Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

4. Plans, credits, and billing

• Credits. Generating triage analyses and proposals consumes credits. Free accounts receive a one-time credit allotment. Credit usage is recorded in an append-only ledger.
• Pro subscription. The Pro plan is billed on a recurring monthly basis and automatically renews until cancelled. Monthly credits may roll over up to the stated cap.
• Credit packs. One-time credit packs are charged at purchase.
• Payments. Payments are processed by Stripe and billed by Bitficial LLC. You authorize us to charge your selected payment method for the plan or pack you choose.
• Cancellation. You may cancel your subscription at any time through the billing portal; you retain access until the end of the current billing period.
• Refunds. Except where required by law, payments are non-refundable and consumed credits are not refundable.
• Pricing changes. We may change pricing or plan features; changes apply to future billing periods.

5. Acceptable use

• Provide accurate information about yourself. You are responsible for the accuracy of your profile and for reviewing every proposal before you submit it.
• Do not misrepresent your identity or submit another person’s work as your own.
• Do not use the Service for unlawful, fraudulent, or abusive purposes.
• Do not attempt to reverse engineer, scrape, overload, or circumvent the security or rate limits of the Service.

6. AI-generated content and no guarantees

The Service uses automated systems and large language models. Output may contain errors or inaccuracies and is provided as a starting point that you must review and edit. We do not guarantee any particular outcome, including that you will win work, receive responses, or rank highly on any platform. You are solely responsible for what you submit using the Service.

7. Intellectual property

You retain ownership of the content you provide and of the proposals generated for you. You grant us a limited license to process your content solely to operate and provide the Service. We retain all rights in the Service itself — including our software, template library, design, and brand. You may not copy or resell the Service.

8. Third-party services

The Service relies on third-party providers (including Supabase, Vercel, Stripe, Anthropic, OpenAI, Hugging Face, and Sentry). Your use of the Service is also subject to those providers’ terms where applicable. We are not responsible for third-party services outside our control.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, Bitficial LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100.

11. Indemnification

You agree to indemnify and hold harmless Bitficial LLC from claims arising out of your content, your use of the Service, or your violation of these Terms or any third-party rights.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to us or others.

13. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. The courts located in Wyoming will have jurisdiction over disputes, except where applicable law provides otherwise.

14. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, take reasonable steps to notify you. Continued use after changes take effect constitutes acceptance.
